Terms of Service (ToS)

These Terms of Service (ToS) govern the use of the platform BattleMySong (hereinafter the "Platform") by registered users. The operator is Konstantin Albrecht (contact: battlemysongde@gmail.com).

By registering for and using the Platform, you accept these ToS in their current version. Deviating terms proposed by the user shall not be recognized unless the operator expressly agrees to their application in writing.

The Platform is intended for users of legal age. Minors may only use the Platform with the consent of a parent or legal guardian.

BattleMySong is an online platform for music battles: users submit AI-generated or self-created songs via Suno link or MP3 upload, which are matched in random pairings against each other, and other users vote. Songs receive an ELO rating; leaderboards and profiles display achievements and statistics.

The operator provides the technical infrastructure. There is no entitlement to uninterrupted availability, specific matchmaking outcomes, or particular rankings on leaderboards.

The operator is entitled to further develop, modify, or discontinue Platform features, provided users are not unreasonably disadvantaged thereby.

Use of the Platform requires registration with a pseudonym, email address, and password. You are obliged to provide accurate information and to keep your login credentials confidential.

Each user may create only one account. Sharing your account with third parties is prohibited.

The operator may suspend or delete accounts if users violate these ToS, infringe third-party rights, or misuse the Platform.

Users may submit songs via public Suno links or as an MP3 upload (optionally with a cover) and assign them to pools (music categories). After successful submission, songs appear immediately on the profile and — if chosen — can participate in battles right away. There is no pre-publication review by moderators.

Upon submission, you expressly confirm that:

• you hold the necessary rights to the track and/or, for Suno links, that Suno's terms of use permit the submission;
• the track does not contain unlicensed samples or protected lyrics without authorization;
• you permit the Platform to store, embed, and play the track within battles, playlists, and promotional activities.

A slot limit applies for concurrently active tracks per user. The operator may reject submissions or remove them afterwards if legal requirements, quality standards, or platform policies are not met.

You retain all copyright and related rights in your submitted songs. By submitting a track, you grant the operator a simple, non-exclusive, royalty-free license limited in scope, territory, and time to the duration of its integration on the Platform, to store and play the songs within the Platform, use them in battles, display them on leaderboards, and promote them.

This license ends when you archive or delete the track or when the operator terminates its integration. Battles that have already taken place and votes cast remain in anonymized/statistical form for leaderboard integrity where technically necessary.

You agree in particular to:

• not submit unlawful, offensive, discriminatory, or youth-endangering content;
• not infringe third-party rights (copyright, trademark, personality rights);
• not manipulate votes, rankings, or matchmaking;
• not use automated access (bots, scrapers) without authorization;
• not provide false information during registration or submission.

Violations may result in rejection of submissions, account suspension, or deletion of content.

Registered users receive a daily allowance of points with which they can participate in battles and vote. Points have no monetary value, are non-transferable, and cannot be redeemed for cash.

The daily allowance resets at midnight Europe/Berlin. The operator may adjust the amount and rules of the points system and sanction misuse.

Platform songs are published without prior review. The operator may remove songs afterwards or restrict accounts if legal violations exist or these ToS are breached.

Users may report content. The operator reviews reports and takes appropriate measures but is not obliged to monitor all content in advance. Separate formats (e.g. mini battles) may have their own approval steps where indicated in the respective feature.

The operator is liable without limitation in cases of intent and gross negligence, as well as for damage arising from injury to life, body, or health. In cases of slight negligence, the operator is liable only for breach of essential contractual obligations (cardinal duties), limited to foreseeable, typical contractual damage.

For user-generated content (submitted songs, profile texts, avatars), the operator is liable only once it has positive knowledge of a legal violation and fails to act without undue delay.

The Platform links to external services (e.g. Suno). The respective provider is responsible for their content.

You may delete your account at any time by contacting us at battlemysongde@gmail.com. The operator may terminate the user relationship without notice for good cause.

After termination, personal data will be deleted in accordance with our Privacy Policy, unless statutory retention obligations apply.

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer with your habitual residence in the EU, mandatory consumer protection provisions of your country of residence remain unaffected.

Should individual provisions of these ToS be invalid, the validity of the remaining provisions shall remain unaffected.

The operator may amend these ToS with effect for the future. Registered users will be informed of material changes in an appropriate manner.
